This retainer agreement for vaulting services establishes the attorney-client relationship that protects your AI conversations.
This Agreement is between you ("Client") and the attorney assigned to your LitigationVault.ai account ("Attorney") regarding the vaulting of your AI-assisted communications.
1. Scope of Services. The Attorney agrees to provide vaulting review services: reviewing your AI-generated communications stored in your LitigationVault.ai vault to maintain attorney-client privilege over those communications.
2. The AI Is Not a Lawyer. The AI tools in this platform are computer programs. They are not lawyers. Their outputs are computer-generated and should not be relied upon as legal advice until reviewed by your Attorney.
3. Fees. The monthly fee of $50.00 covers the retainer for vaulting services and platform access. Substantive legal follow-up may be billed separately.
4. Privilege. Your use of AI through this platform is structured to be protected by attorney-client privilege because it occurs at the direction of your Attorney under this retainer.
5. Confidentiality. All communications are encrypted. AI models are accessed through enterprise APIs with zero data retention. Your inputs are not used to train AI models.
6. Evolving Area of Law. No court has definitively ruled on this exact scenario. Neither the Attorney nor LitigationVault.ai can guarantee privilege will be upheld in all circumstances.
7. Your Responsibilities. You agree to: (a) provide accurate information; (b) not use public AI tools for matter-related communications; (c) not share login credentials; (d) consult your Attorney before making legal decisions.
8. Cancellation. You may cancel at any time.
This Agreement is between your law firm ("Firm") and LitigationVault.ai ("Platform") regarding the provision of privilege-preserving AI infrastructure for your clients.
1. Scope. The Platform provides a secure AI workspace where your Firm can invite clients to interact with AI models (Claude, ChatGPT, Gemini, or self-hosted). All client communications are vaulted, encrypted, and accessible to your Firm's attorneys for review. The Platform positions AI as a Kovel agent of your Firm's counsel.
2. Your Firm's Role. Your attorneys create workspaces, invite clients, select approved AI models, and review client AI interactions. This attorney direction is what establishes and maintains privilege over client communications.
3. The AI Is Not a Lawyer. AI outputs are computer-generated and not legal advice. All outputs include disclaimers and are flagged for attorney review. Your Firm is responsible for legal guidance.
4. Client Engagement. When you invite a client, they sign a click-through AI Use Agreement acknowledging: the AI is not a lawyer, privilege is evolving, and attorney review is required. Your Firm may also use its own engagement letter with AI addendum provisions (templates provided).
5. Billing. Attorney review time is tracked and can be synced to Clio or other practice management tools. Time entries are suggestions — your Firm controls all billing decisions.
6. Confidentiality. All data is encrypted at rest and in transit. AI models are accessed via enterprise APIs with zero data retention. No client data is used for model training or accessed by Platform staff.
7. Evolving Area of Law. The application of attorney-client privilege to AI-assisted communications is new legal territory. The Platform is designed to provide the strongest possible privilege position, but no guarantee is made. A locally-hosted AI model option is available for maximum security.
8. Fees. Your selected plan pricing applies. Cancellation is available at any time.
