AI AGREEMENT

AI Use Agreement

Effective Date: March 1, 2026

What This Platform Is

Before using AI through LitigationVault.ai, it is important that you understand what this platform does and does not do. Please review the following key points:

A vaulting service, not a law firm

LitigationVault.ai provides attorney-directed AI vaulting services. We are not a law firm and do not provide traditional legal representation.

AI analysis, not legal advice

AI-generated responses are computer analysis based on training data. They are not legal advice from a licensed attorney.

Privilege protection through structure

Your conversations are encrypted, vaulted, and reviewed by your assigned attorney to create the foundation for attorney-client privilege.

Court outcomes are not guaranteed

While our platform is designed to satisfy privilege requirements, courts make privilege determinations on a case-by-case basis.

AI Is Not a Lawyer

Important Disclaimer

AI-generated responses on this platform are produced by computer programs (large language models) and are not legal advice. They may contain errors, hallucinations, outdated information, or analysis that does not apply to your jurisdiction or specific circumstances. Never make legal decisions based solely on AI output. Always consult with your assigned attorney for guidance on your legal matter.

Every AI response on this platform includes a disclaimer identifying it as computer-generated analysis. Your assigned attorney reviews vaulted conversations but does not independently verify every factual statement made by the AI. The AI does not have access to your complete legal file, court records, or opposing counsel's arguments unless you provide them.

How AI Responses Work

When you ask a question on the Platform, your query is sent to the AI provider you selected (Claude, ChatGPT, Gemini, or a private model) via enterprise API endpoints with Zero Data Retention agreements. The AI generates a response based on its training data, which is then encrypted and stored in your vault. Your assigned attorney is notified and can review the conversation.

AI responses are generated in real time and are not pre-reviewed by an attorney before you see them. The attorney review happens after the response is vaulted. This means you may see AI output that is incorrect or incomplete before your attorney has had a chance to review it.

How Privilege Is Protected

Retainer agreement establishes attorney-client relationship

All conversations encrypted with AES-256 at rest and TLS 1.3 in transit

AI providers operate under Zero Data Retention agreements

Attorney reviews create the direction element required for privilege

Complete audit trail maintained for privilege verification

Evolving Law

Attorney-Client Privilege & AI Is New Legal Territory

Courts are still determining how attorney-client privilege applies to AI-assisted legal communications. While our platform is structured to satisfy established privilege requirements, this is a rapidly evolving area of law. New court decisions may affect how privilege is applied to AI-generated content. We monitor legal developments continuously and update our practices accordingly.

Your Responsibilities

By using this platform, you accept the following responsibilities:

1

I will review all AI-generated responses critically and not rely on them as legal advice

2

I will consult with my assigned attorney for legal guidance on my specific situation

3

I will not share my vault access credentials with anyone

4

I will provide accurate information about my legal matter to receive relevant analysis

5

I understand that AI responses may contain errors, omissions, or outdated information

6

I will notify my attorney of any time-sensitive legal deadlines or upcoming court dates

AI Models & Data Handling

The Platform currently supports Claude (Anthropic), ChatGPT (OpenAI), Gemini (Google), and privately-hosted models. All AI providers operate under enterprise agreements with Zero Data Retention. Your data is never used to train AI models. We may add or remove AI providers with notice to users.

Document Uploads

Documents uploaded to the Platform are encrypted and stored in your vault. They may be submitted to AI providers for analysis under the same ZDR protections. Uploaded documents are not accessible to other users or to LitigationVault.ai staff (except your assigned attorney).

No Guarantees

We do not guarantee any particular legal outcome, the accuracy of AI-generated responses, or that a court will uphold privilege over your vaulted communications. The Platform is a tool to help you access AI analysis within a structure designed for privilege protection. Your legal outcomes depend on many factors beyond the scope of this platform.

Billing

Your subscription fee covers platform access, AI usage, vaulting services, and standard attorney review. Extended attorney consultations, document drafting, or legal representation beyond vaulting review are billed separately at your attorney's stated rate. See our Terms of Service for complete billing details.

Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access through the end of your current billing period. You will have 30 days after cancellation to export your vaulted data. Your vaulted data will be retained in accordance with our data retention policy for privilege preservation purposes.
